4. क्रेडिट गारंटी फंड स्कीम फॉर स्किल डेवलपमेंट (सीजीएफएसएसडी): यह व्यावसायिक और कौशल विकास संबंधी पाठ्यक्रमों के लिए है।

2.रुपये 4 लाख से अधिक और 7.5 लाख से कम तक का लोन : इस श्रेणी में, बैंक एक आर्थिक रूप से संपन्न गारंटर की मांग करते हैं, लेकिन कोलेटरल की जरूरत नहीं होती। यह मध्यम आकार के शिक्षा ऋण के लिए उपयुक्त है।

3. रुपये 7.5 लाख से अधिक का लोन : इस श्रेणी में, ऋण लेने वाले को न केवल एक संपन्न गारंटर की आवश्यकता होती है, बल्कि कोलेटरल की भी जरूरत होती है। यह विकल्प उन छात्रों के लिए उपयुक्त है जो बड़ी राशि का ऋण चाहते हैं, चाहे वह भारत में हो या विदेश में।

इन लोन श्रेणियों के अंतर्गत, छात्र अपनी आवश्यकता और पात्रता के अनुसार सर्वोत्तम विकल्प चुन सकते हैं। यह महत्वपूर्ण है कि लोन लेने से पहले सभी शर्तों और नियमों को समझ लिया जाए।

    ऋण विभिन्न कैटेगरीजों में प्रदान करते हैं, जिसमें शर्तें और ऋण की राशि कॉलेज की रैंकिंग और छात्र के शैक्षणिक पाठ्यक्रम के आधार पर होती हैं। ये ऋण सामान्यत: सरकारी बैंकों से महंगे होते हैं, और इनके लिए एक मजबूत गारंटर या को-एप्लिकेंट, और कई मामलों में कोलेटरल की आवश्यकता होती है। ये ऋण खासकर उन छात्रों के लिए हैं जो उच्च रैंकिंग वाले संस्थानों में प्रवेश प्राप्त करते हैं या विदेश में पढ़ाई करने के इच्छुक होते हैं। इन शर्तों के अनुसार, ऋण की राशि और इसके लिए आवश्यक सुरक्षा का निर्धारण होता है।

निजी बैंकों में मिलेंगी कुछ अलग शर्तें

देश के निजी बैंकों द्वारा प्रदान किए जाने वाले शिक्षा ऋण सरकारी बैंकों की तुलना में थोड़े महंगे और कठिन होते हैं। यहां किसी भी ऋण के लिए छात्र के साथ एक गारंटर की आवश्यकता होती है, जिसे को-ऐप्लिकेंट कहा जाता है। निजी बैंकों से आप छह विभिन्न कैटेगरीज में शिक्षा ऋण प्राप्त कर सकते हैं, जिन्हें कॉलेज की रैंकिंग के आधार पर तय किया गया है।

1.जनरल कैटेगरी (रुपये 1 लाख से 7.5 लाख तक का ऋण): इस कैटेगरी के लिए आपको एक मजबूत गारंटर या को-एप्लिकेंट की आवश्यकता है, हालांकि इस ब्रैकेट के लिए कोलेटरल की आवश्यकता नहीं होती है।

2. प्राइम सी कैटेगरी (रुपये 15 लाख तक का ऋण) : इसमें आप एजुकेशनल लोन प्राप्त कर सकते हैं, साथ ही एक को-एप्लिकेंट और गारंटर की भी आवश्यकता होती है।

4. प्राइम ए कैटेगरी (50 लाख तक का शिक्षा ऋण) : इसके तहत आपको देश के शीर्ष संस्थानों में दाखिला होने पर एजुकेशनल लोन मिल सकता है, लेकिन इसके लिए गारंटर और को-एप्लिकेंट की आवश्यक

शिक्षा का अधिकार (RTE) अधिनियम, 2009 (Right to Education (RTE) Act, 2009)

  • शिक्षा का अधिकार अधिनियम (आरटीई) एक महत्वपूर्ण कानून है जो भारत की शैक्षिक प्रणाली में एक महत्वपूर्ण मोड़ का प्रतिनिधित्व करता है। इसके लागू होने के बाद से देश में शिक्षा का अधिकार एक बुनियादी अधिकार बन गया है।
  • शिक्षा का अधिकार अधिनियम (आरटीई) ने 2009 में बच्चों को मुफ्त और अनिवार्य शिक्षा प्रदान की और इसे  अनुच्छेद 21-ए के तहत एक मौलिक अधिकार के रूप में लागू किया।
  • शिक्षा का अधिकार अधिनियम का पूर्ण शीर्षक  “बच्चों को निःशुल्क एवं अनिवार्य शिक्षा का अधिकार अधिनियम” है । इसे अगस्त 2009 में संसद द्वारा पारित किया गया था। जब यह अधिनियम 2010 में लागू हुआ, तो भारत उन 135 देशों में से एक बन गया जहां शिक्षा हर बच्चे का मौलिक अधिकार है।
  • 86 वें संवैधानिक संशोधन (2002) ने भारतीय संविधान में अनुच्छेद 21ए डाला जिसमें कहा गया है:
    • “राज्य  6 से 14 वर्ष के सभी बच्चों को मुफ्त और अनिवार्य शिक्षा  उस तरीके से प्रदान करेगा जैसा राज्य कानून द्वारा निर्धारित कर सकता है।”
  • इसके अनुसार, शिक्षा के अधिकार को  मौलिक अधिकार बना दिया गया  और राज्य के नीति निदेशक सिद्धांतों की सूची से हटा दिया गया।
  • आरटीई 86वें संशोधन के तहत परिकल्पित परिणामी कानून है।
  • लेख के शीर्षक में “मुक्त” शब्द शामिल है । इसका मतलब यह है कि कोई भी बच्चा (सरकार द्वारा समर्थित स्कूल में उसके माता-पिता द्वारा भर्ती कराए गए बच्चों के अलावा) किसी भी प्रकार की फीस या शुल्क या खर्च का भुगतान करने के लिए उत्तरदायी नहीं है जो उसे प्रारंभिक शिक्षा प्राप्त करने और पूरा करने से रोक सकता है। .
  • यह अधिनियम छह से चौदह वर्ष की आयु वर्ग के सभी बच्चों के लिए प्रवेश, उपस्थिति और प्रारंभिक शिक्षा पूरी करना सुनिश्चित करना सरकार के लिए अनिवार्य बनाता है ।
  • अनिवार्य रूप से, यह अधिनियम समाज के आर्थिक रूप से कमजोर वर्गों के सभी बच्चों को मुफ्त प्रारंभिक शिक्षा सुनिश्चित करता है ।

संवैधानिक पृष्ठभूमि

  • मूल रूप से भारतीय संविधान के भाग IV,  अनुच्छेद 45 और डीपीएसपी के अनुच्छेद 39 (एफ) में  राज्य वित्त पोषित के साथ-साथ न्यायसंगत और सुलभ शिक्षा का प्रावधान था।
  • शिक्षा के अधिकार पर पहला आधिकारिक दस्तावेज़  1990 में राममूर्ति समिति की रिपोर्ट थी।
  • 1993 में, उन्नीकृष्णन जेपी बनाम आंध्र प्रदेश राज्य और अन्य मामले में सुप्रीम कोर्ट के ऐतिहासिक फैसले में   कहा गया कि  शिक्षा अनुच्छेद 21 से प्राप्त एक मौलिक अधिकार है।
  • तापस मजूमदार समिति (1999) की  स्थापना की गई, जिसमें  अनुच्छेद 21ए को शामिल किया गया।
  •  2002 में भारत के संविधान में 86 वें संशोधन द्वारा  संविधान के भाग-III में शिक्षा के अधिकार को मौलिक अधिकार के रूप में  प्रदान किया गया  ।
  • उसी संशोधन में  अनुच्छेद 21ए शामिल किया गया जिसने शिक्षा के अधिकार को 6-14 वर्ष  के बच्चों के लिए मौलिक अधिकार बना दिया  ।
  • 86वें संशोधन में  शिक्षा का अधिकार विधेयक 2008 और अंततः  शिक्षा का अधिकार अधिनियम 2009 के लिए  अनुवर्ती कानून का प्रावधान किया गया।

शिक्षा का अधिकार (आरटीई) अधिनियम, 2009 की विशेषता

  • आरटीई अधिनियम का लक्ष्य  6 से 14 वर्ष की आयु के सभी बच्चों को प्राथमिक शिक्षा प्रदान करना है।
  • यह शिक्षा को मौलिक अधिकार के रूप में लागू करता है (अनुच्छेद 21)।
  • अधिनियम यह स्पष्ट करता है कि ‘ अनिवार्य शिक्षा ‘ का तात्पर्य है कि छह से चौदह वर्ष की आयु के बच्चों का प्रवेश, उपस्थिति और प्रारंभिक शिक्षा पूरी करना सुनिश्चित करना सरकार का दायित्व है। ‘मुफ़्त’ शब्द इंगित करता है कि बच्चे द्वारा कोई शुल्क देय नहीं है जो उसे ऐसी शिक्षा पूरी करने से रोक सकता है।
  • यह अधिनियम   समाज के वंचित वर्गों के लिए 25% आरक्षण का आदेश देता है जहां वंचित समूहों में शामिल हैं:
    • एससी और एसटी
    • सामाजिक रूप से पिछड़ा वर्ग
    • अलग रूप से सक्षम
  • यह गैर-प्रवेशित बच्चे को  आयु के अनुरूप कक्षा में प्रवेश देने का भी प्रावधान करता है।
  • इसमें केंद्र और राज्य सरकारों के बीच वित्तीय और अन्य जिम्मेदारियों को साझा करने की बात भी कही गई है ।
  • यह निम्नलिखित से संबंधित मानदंड और मानक निर्धारित करता है:
    • छात्र शिक्षक अनुपात (पीटीआर)
    • इमारतें और बुनियादी ढाँचा
    • स्कूल-कार्य दिवस
    • शिक्षक-कार्य के घंटे.
  • इसमें “नो डिटेंशन पॉलिसी” का एक खंड था   जिसे  बच्चों के मुफ्त और अनिवार्य शिक्षा का अधिकार (संशोधन) अधिनियम, 2019 के तहत हटा दिया गया है ।
  • इसमें यह भी कहा गया है कि शिक्षकों की तैनाती में शहरी-ग्रामीण असंतुलन नहीं होना चाहिए।
  • यह दशकीय जनगणना, स्थानीय प्राधिकरण, राज्य विधानसभाओं और संसद के चुनावों और आपदा राहत के अलावा गैर-शैक्षणिक कार्यों के लिए शिक्षकों की तैनाती पर रोक लगाने का भी प्रावधान करता है ।
  • यह अपेक्षित प्रवेश और शैक्षणिक योग्यता वाले शिक्षकों की नियुक्ति का प्रावधान करता है।
  • यह निषेध करता है
    • शारीरिक दण्ड एवं मानसिक उत्पीड़न
    • बच्चों के प्रवेश के लिए स्क्रीनिंग प्रक्रियाएँ
    • कैपिटेशन शुल्क
    • शिक्षकों द्वारा निजी ट्यूशन
    • बिना मान्यता के स्कूल चलाना
  • यह बाल मैत्रीपूर्ण और बाल केंद्रित शिक्षा प्रणाली के माध्यम से बच्चे को भय, आघात और चिंता से मुक्त बनाने पर केंद्रित है।
  • अधिनियम में परिकल्पना की गई है कि पाठ्यक्रम को भारतीय संविधान में निहित मूल्यों के अनुरूप विकसित किया जाना चाहिए, और जो बच्चे के सर्वांगीण विकास का ध्यान रखेगा। पाठ्यक्रम को बच्चे के ज्ञान, उसकी क्षमता और प्रतिभा पर आधारित होना चाहिए, बच्चे को एक ऐसी प्रणाली के माध्यम से आघात, भय और चिंता से मुक्त करने में मदद करनी चाहिए जो बाल-केंद्रित और बाल-अनुकूल दोनों हो।

RTE का महत्व

  • शिक्षा का अधिकार अधिनियम पारित होने के साथ, भारत सभी के लिए शिक्षा को लागू करने की दिशा में अधिकार-आधारित दृष्टिकोण की ओर बढ़ गया है। यह अधिनियम एक बच्चे के मौलिक अधिकारों (संविधान के अनुच्छेद 21 ए के अनुसार) को क्रियान्वित करने के लिए  राज्य और केंद्र सरकारों पर कानूनी दायित्व डालता है।
  • अधिनियम छात्र-शिक्षक अनुपात के लिए विशिष्ट मानक निर्धारित करता है , जो गुणवत्तापूर्ण शिक्षा प्रदान करने में एक बहुत महत्वपूर्ण अवधारणा है।
  • इसमें लड़कियों और लड़कों के लिए अलग-अलग शौचालय की सुविधा उपलब्ध कराने , कक्षा की स्थितियों के लिए पर्याप्त मानक, पीने के पानी की सुविधा आदि के बारे में भी बात की गई है ।
  • शिक्षकों की नियुक्ति में शहरी-ग्रामीण असंतुलन से बचने पर जोर देना महत्वपूर्ण है क्योंकि देश में शहरी क्षेत्रों की तुलना में गांवों में शिक्षा की गुणवत्ता और संख्या में बड़ा अंतर है।
  • यह अधिनियम बच्चों के उत्पीड़न और भेदभाव के खिलाफ शून्य सहिष्णुता का प्रावधान करता है । प्रवेश के लिए स्क्रीनिंग प्रक्रियाओं पर रोक यह सुनिश्चित करती है कि जाति, धर्म, लिंग आदि के आधार पर बच्चों के साथ कोई भेदभाव नहीं होगा।
  • अधिनियम यह भी कहता है कि किसी भी बच्चे को कक्षा 8 तक रोका नहीं जाएगा।  इसने स्कूलों में ग्रेड-उपयुक्त सीखने के परिणाम प्राप्त करने के लिए 2009 में सतत व्यापक मूल्यांकन (सीसीई) प्रणाली की शुरुआत की।
  • अधिनियम सभी प्रारंभिक विद्यालयों में सहभागी लोकतंत्र और शासन को बढ़ावा देने के लिए प्रत्येक स्कूल में एक स्कूल प्रबंधन समिति (एसएमसी) के गठन का भी प्रावधान करता है। इन समितियों के पास स्कूल के कामकाज की निगरानी करने और इसके लिए विकासात्मक योजनाएँ तैयार करने का अधिकार है।
  • अधिनियम न्यायसंगत है और इसमें एक शिकायत निवारण तंत्र है जो अधिनियम के प्रावधानों का अनुपालन नहीं होने पर लोगों को कार्रवाई करने की अनुमति देता है।
  • आरटीई अधिनियम सभी निजी स्कूलों को सामाजिक रूप से वंचित और आर्थिक रूप से पिछड़े वर्गों के बच्चों के लिए अपनी 25 प्रतिशत सीटें आरक्षित करने का आदेश देता है। इस कदम का उद्देश्य सामाजिक समावेशन को बढ़ावा देना और अधिक न्यायपूर्ण और समान देश का मार्ग प्रशस्त करना है।
  • यह प्रावधान आरटीई अधिनियम की धारा 12(1)(सी) में शामिल है। सभी स्कूलों (निजी, गैर सहायता प्राप्त, सहायता प्राप्त या विशेष श्रेणी) को प्रवेश स्तर पर अपनी 25% सीटें आर्थिक रूप से कमजोर वर्ग (ईडब्ल्यूएस) और वंचित समूहों के छात्रों के लिए आरक्षित करनी होंगी।
  • जब 2005 में अधिनियम का कच्चा संस्करण तैयार किया गया था, तो वंचितों के लिए आरक्षित सीटों के इस बड़े प्रतिशत के खिलाफ देश में बहुत आक्रोश था। हालाँकि, मसौदा तैयार करने वाले अपनी बात पर अड़े रहे और निजी स्कूलों में 25% आरक्षण को उचित ठहराने में सफल रहे।
  • यह प्रावधान एक दूरगामी कदम है और जहां तक  समावेशी शिक्षा  का सवाल है, शायद सबसे महत्वपूर्ण कदम है।
  • यह प्रावधान सामाजिक एकीकरण हासिल करना चाहता है।
  • इस अधिनियम ने 2009 और 2016 के बीच उच्च प्राथमिक स्तर (कक्षा 6-8) में नामांकन में 19.4% की वृद्धि की है ।
  • ग्रामीण क्षेत्रों में, 2016 में, 6-14 वर्ष आयु वर्ग के केवल 3.3% बच्चे स्कूल से बाहर थे।
  • इससे स्कूलों को होने वाले नुकसान की भरपाई केंद्र सरकार करेगी।

शिक्षा का अधिकार अधिनियम, 2009 की उपलब्धियाँ

  • आरटीई अधिनियम उच्च प्राथमिक स्तर (कक्षा 6-8) में नामांकन बढ़ाने में सफलतापूर्वक कामयाब रहा है।
  • कड़े बुनियादी ढांचे के मानदंडों के परिणामस्वरूप स्कूल के बुनियादी ढांचे में सुधार हुआ, खासकर ग्रामीण क्षेत्रों में।
  • 3.3 मिलियन से अधिक छात्रों ने आरटीई के तहत 25% कोटा मानदंड के तहत प्रवेश प्राप्त किया।
  • इसने शिक्षा को देशभर में समावेशी और सुलभ बनाया।
  • “नो डिटेंशन पॉलिसी” को हटाने से प्रारंभिक शिक्षा प्रणाली में जवाबदेही आई है।
  • सरकार ने स्कूली शिक्षा के लिए  समग्र शिक्षा अभियान नाम से एक एकीकृत योजना भी शुरू की है,  जिसमें स्कूली शिक्षा की तीन योजनाएं शामिल हैं:
    • सर्व शिक्षा अभियान (एसएसए)
    • राष्ट्रीय माध्यमिक शिक्षा अभियान (आरएमएसए)
    • शिक्षक शिक्षा पर केंद्र प्रायोजित योजना (सीएसएसटीई)।

शिक्षा का अधिकार अधिनियम, 2009 की सीमाएँ

  • जिस आयु समूह के लिए शिक्षा का अधिकार उपलब्ध है , वह केवल 6-14 वर्ष की आयु तक है, जिसे 0-18 वर्ष तक विस्तारित करके अधिक समावेशी और समावेशी बनाया जा सकता है ।
  • 6 वर्ष से कम उम्र के बच्चे इस अधिनियम के अंतर्गत शामिल नहीं हैं।
  • सीखने की गुणवत्ता पर कोई ध्यान नहीं है , जैसा कि कई  एएसईआर रिपोर्टों से पता चलता है,  इस प्रकार आरटीई अधिनियम ज्यादातर इनपुट उन्मुख प्रतीत होता है।
  • पांच राज्यों गोवा, मणिपुर, मिजोरम, सिक्किम और तेलंगाना ने आरटीई के तहत समाज के वंचित बच्चों के लिए 25% सीटों के संबंध में अधिसूचना भी जारी नहीं की है।
  • शिक्षा की गुणवत्ता की बजाय आरटीई के आंकड़ों पर अधिक ध्यान दिया जा रहा है।
  • शिक्षकों की कमी आरटीई द्वारा अनिवार्य छात्र-शिक्षक अनुपात को प्रभावित करती है जिसके परिणामस्वरूप शिक्षण की गुणवत्ता प्रभावित होती है।
  • अधिनियम के तहत कई योजनाओं की तुलना सर्व शिक्षा अभियान जैसी शिक्षा पर पिछली योजनाओं से की गई है, और भ्रष्टाचार के आरोपों और अक्षमता से ग्रस्त हैं ।
  • एडमिशन के समय कई दस्तावेजों जैसे जन्म प्रमाण पत्र, बीपीएल प्रमाण पत्र आदि की आवश्यकता होती है। ऐसा प्रतीत होता है कि इस कदम से अनाथ बच्चे इस अधिनियम के लाभार्थी बनने से वंचित रह गये हैं ।
  • निजी स्कूलों में ईडब्ल्यूएस और अन्य के लिए सीटों के 25% आरक्षण में कार्यान्वयन संबंधी बाधाएँ हैं। इस संबंध में कुछ चुनौतियाँ माता-पिता के प्रति भेदभावपूर्ण व्यवहार और छात्रों द्वारा एक अलग सामाजिक-सांस्कृतिक परिवेश में फिट होने में अनुभव की जाने वाली कठिनाइयाँ हैं।
  • कक्षा 8 तक ‘ नो डिटेंशन’ नीति के संबंध में , 2019 में अधिनियम में एक संशोधन, कक्षा 5 और 8 में नियमित वार्षिक परीक्षा की शुरुआत की गई।
    • यदि कोई छात्र वार्षिक परीक्षा में असफल हो जाता है, तो उसे अतिरिक्त प्रशिक्षण दिया जाता है और पुनः परीक्षा में बैठने के लिए कहा जाता है। यदि यह पुनः परीक्षा उत्तीर्ण नहीं होती है, तो छात्र को कक्षा में रोका जा सकता है ।
